Terms of Service

1. What AudienceBeast does

AudienceBeast reads a website you give us, suggests ad ideas, makes images and videos with AI and other tools, and lets you download them or post them to accounts you connect.

Nothing is posted without your explicit approval. You choose what is made, what is published, where and when.

2. Who may use it

You must be at least 18 and able to enter a binding contract. AudienceBeast is a tool for businesses and professionals.

You may only scan websites, and connect accounts, that you own or are allowed to market. Keep your login safe; you are responsible for everything done with your account.

3. Your content and your responsibility

You are the author and publisher of every ad you approve, download or post. You alone are responsible for it: its claims, offers, prices, images, music, people shown, targeting and compliance with the law and with each platform's rules (Meta, TikTok, YouTube, LinkedIn and others).

AI output can be wrong, invented, similar to existing work or unsuitable. Our analysis of your brand, audiences, competitors, virality scores and best times are estimates, not facts or promises. Review everything before you approve it, and check facts, claims and rights yourself.

You keep the rights you have in what you upload and in the ads you make. You give us a worldwide, non-exclusive, royalty-free licence to host, process, change and display that content only to run AudienceBeast for you, and to keep it as the law requires.

4. Acceptable use

You must not use AudienceBeast to create, store or publish content that:

a) is illegal, or promotes illegal products or services, or breaks consumer, advertising, data protection, sanctions or election law;

b) is false or misleading: invented reviews, results, prices, discounts, scarcity, endorsements or health, financial or legal claims you cannot prove;

c) infringes anyone's copyright, trademark, image, privacy or other rights, including other brands' logos, ads, footage or music used without permission;

d) impersonates a person, brand or organisation, or uses a real person's likeness or voice without consent, including deepfakes;

e) harasses, defames, threatens or discriminates against anyone, or attacks a competitor with false statements;

f) is sexual or exploits minors in any way, is violent, extremist or hateful, or promotes self harm;

g) is spam, scams, phishing, malware, pyramid schemes or unlicensed gambling, weapons, drugs or financial products;

h) targets or is designed for children.

You must also not: scan sites you have no right to market; use AudienceBeast to harm a third party; try to get around credits, limits or safety filters; scrape, copy, resell or reverse engineer the service; overload it; or use it to build a competing product.

5. What we may do

We may refuse to generate content, remove or block content, limit features, and suspend or close an account that breaks these terms or the law, or that puts other users, third parties or us at risk. Where reasonable we tell you why and let you respond; where the risk is serious or the law requires it, we act first.

Anyone can report illegal or harmful content made with AudienceBeast to legal@audiencebeast.com. We review reports promptly and may share information with authorities when the law requires it.

We do not review your content before you publish it and have no duty to monitor it, but we may use automated checks to prevent misuse.

6. Credits, plans and payment

Ideas and text are free; credits are spent when media is made. Plans, prices and credit costs are shown in the app and may change with notice for the next billing period.

Subscriptions renew until you cancel. Unused monthly credits do not roll over unless the app says so. Credits have no cash value. Credits spent on a failed render are refunded automatically.

Because media is made at your request right away, you agree the service starts immediately and, where the law allows, you lose the right of withdrawal for credits already used. Your other statutory rights stay intact.

7. Third party services

AudienceBeast works with services we do not control: AI models, stock libraries such as Pixabay, social networks and payment providers. Their terms also apply to you. A platform may reject, limit or remove your post or account; we are not responsible for their decisions or outages.

Inspiration shown from public posts and competitor ads is for reference only. We copy structure, never footage, audio, people or brand names, and you must not either.

8. Indemnity

You will defend and compensate us, our team and partners against any claim, fine, loss or cost (including reasonable legal fees) that comes from your content, your ads, your use of AudienceBeast, or your breach of these terms or of anyone's rights. This does not apply to the extent the harm was caused by our own breach.

9. No guarantees and limits of liability

AudienceBeast is provided as it is and as available. We do not promise any reach, sales, results, uptime or that AI output is accurate, original or fit for your purpose.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profit, revenue, data or reputation, or for content you publish. Our total liability for any claim is limited to what you paid us in the 12 months before it arose, or €100 if you paid nothing.

Nothing here limits liability for death or injury caused by negligence, for fraud, or any liability the law does not allow us to limit, including your rights as a consumer.

10. Ending and changes

You can stop using AudienceBeast and delete your account at any time. We may end the service with 30 days' notice, or immediately under section 5.

We may change these terms. We tell you about important changes in the app or by email at least 15 days before they apply; if you keep using AudienceBeast after that, you accept them.

11. Law and disputes

Portuguese law applies and the courts of Leiria decide disputes, without removing the protection of the law of the country where you live if you are a consumer. Consumers in Portugal may also use an alternative dispute resolution centre listed at www.consumidor.gov.pt.

If a clause is invalid, the rest still applies. The English version of these terms prevails over translations.
